Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Six7 (“we,” “our,” or “us”) governing your use of the Six7 mobile application and related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

To use Six7, you must:

• Be at least 13 years old (or 16 years old in the European Economic Area)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Not have been previously banned from the Service

If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent or legal guardian’s permission to use the Service, and they must agree to these Terms on your behalf.

3. Your Account

3.1 Account Creation

To use Six7, you must register using a valid phone number. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any information that changes
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for safeguarding your account. Notify us immediately if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account.

4. Acceptable Use Policy

You agree to use Six7 in compliance with all applicable laws and these Terms. You may NOT use the Service to:

4.1 Illegal Activities

• Violate any local, state, national, or international law
• Engage in or promote illegal activities
• Transmit content that infringes intellectual property rights
• Facilitate financial crimes, fraud, or money laundering

4.2 Child Safety and Exploitation

Six7 has zero tolerance for child sexual abuse material (CSAM) or the exploitation of children. You may NOT use the Service to:

• Create, share, request, or distribute child sexual abuse material (CSAM)
• Engage in grooming or any behavior intended to exploit minors
• Solicit, share, or request sexual content involving minors
• Facilitate or promote child trafficking or exploitation
• Contact minors for sexual purposes or inappropriate relationships

We will:

• Immediately terminate accounts involved in child exploitation
• Report all instances of CSAM and child exploitation to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement authorities
• Cooperate fully with law enforcement investigations
• Preserve evidence as required by law

If you become aware of any child exploitation on our platform, report it immediately through the App or by contacting report@six7.chat.

4.3 Other Harmful Content

• Distribute content promoting violence, terrorism, or self-harm
• Send spam, malware, or phishing attempts
• Share content that is defamatory, obscene, or hateful
• Transmit sexually explicit content without consent

4.4 Harassment and Abuse

• Harass, bully, threaten, or intimidate others
• Stalk or invade the privacy of others
• Impersonate any person or entity
• Collect user information without consent

4.5 Platform Integrity

• Attempt to access accounts or data belonging to others
• Interfere with or disrupt the Service’s infrastructure
• Reverse engineer, decompile, or modify the App
• Use automated systems or bots without authorization
• Circumvent security features or access controls

5. User Content

5.1 Your Content

You retain ownership of content you create and share through Six7. By using the Service, you grant us a limited license to transmit and deliver your content to intended recipients.

5.2 Content Responsibility

You are solely responsible for all content you share. We do not pre-screen content, and due to end-to-end encryption, we cannot access or monitor your messages.

5.3 Reporting Violations

If you receive content that violates these Terms, you can report it through the App. We will investigate reports and take appropriate action.

6. Privacy and Data

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using Six7, you also agree to our Privacy Policy.

7. End-to-End Encryption

Six7 uses end-to-end encryption to protect your communications. This means:

• Only you and your recipients can read your messages
• We cannot access or decrypt your message content
• You are responsible for keeping your device secure
• We cannot recover lost messages or encryption keys

8. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by Six7 and protected by intellectual property laws. You may not:

• Copy, modify, or distribute Six7’s proprietary content
• Use our trademarks without written permission
• Create derivative works based on the Service

9. Third-Party Services

The Service may integrate with or link to third-party services. We are not responsible for third-party content, products, or services. Your use of third-party services is governed by their respective terms.

10. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. We may:

• Modify, suspend, or discontinue features without notice
• Perform maintenance that temporarily affects availability
• Limit service in certain regions or circumstances

11. Account Termination

11.1 Termination by You

You may delete your account at any time through the App settings. Upon deletion, your account information will be removed from our servers.

11.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms or our policies
• Engage in fraudulent or illegal activity
• Create risk or legal exposure for Six7
• Have an inactive account for an extended period

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Provisions regarding intellectual property, disclaimers, liability, and disputes survive termination.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Service will meet your requirements

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIX7 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

14. Indemnification

You agree to indemnify and hold harmless Six7, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you share through the Service

15. Dispute Resolution

15.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at legal@six7.chat to attempt informal resolution.

15.2 Governing Law

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles.

15.3 Jurisdiction

Any disputes shall be resolved in the courts located in Zurich, Switzerland, unless otherwise required by applicable consumer protection laws in your jurisdiction.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by other means. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. General Provisions

• Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Six7.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• No Waiver: Our failure to enforce any right does not waive that right.
• Assignment: You may not assign these Terms without our consent. We may assign our rights freely.
